Privacy statement

In accordance with the Personal Protection Act (the Act) which became enforceable on 15th November 2013 to regulate the processing of personal data in commercial transactions, Prospect Consulting Malaysia and /or Prospect Outsourcing Sdn Bhd (hereinafter collectively defined as “the company” is committed to ensure complete compliance with the Act.

We hope this Notice gives you a good understanding on how we handle job seekers personal data that we collect, process and store in the Company and/or its subsidiaries/associate companies

Your privacy is important

Your right to privacy is important. The following statement outlines how the company manages personal information that it holds about individuals.

Personal information – what is it?

Personal information is any information or an opinion about you (whether true or not) from which the Company can determine your identity. For the purpose of processing your application, we may collect the following personal information from you: –

  • Email
  • Full name
  • Gender
  • Telephone/Handphone number
  • Nationality
  • Date of birth
  • Academic qualification & certification
  • Job Preference and position
  • Photo of user
  • Address
  • Additional social information; website, twitter, linkedin, & facebook
  • Resume
  • I/C or Passport No.
  • Race
  • Citizenship
  • Marital Status
  • Language skills
  • Computer skills
  • Soft Skills
  • Working Experience
  • References

It may range from the very sensitive (eg. medical history or condition) to the everyday (e.g. address and phone number). It would include the opinions of others about your work performance (whether true or not), your work experience and qualifications, psychometric assessment results and other information obtained by the Company in connection with your possible work placements.

Personal information includes sensitive information.

Sensitive information – what is it?

When personal information concerns certain matters, it is considered sensitive information. It is information or opinion about your:

  • racial or ethnic origin;
  • membership of a professional or trade association or membership of a trade union;
  • criminal record;
  • health.

The Company will only collect, use or disclose sensitive information about you in accordance with the law.

In most cases, the Company will only collect, use or disclose sensitive information where it has received your consent.

Who will be collecting your personal information?

Your personal information will be collected by the Company to provide you with your interviews with our clients and possible work placement.

The Company may also collect your personal information on behalf of Prospect Consulting Malaysia (PCM) and Prospect Outsourcing Sdn Bhd (POSB) in connection with the possible work placement.

How your information will be collected?

Generally, the Company collects personal information directly from you. For example, it collects personal information when you:

  • deal with the Company in person, by telephone, letter, fax or email;
  • supply a resume;
  • fill out and submit a registration form;
  • submit any other information in connection with your application for registration;
  • complete psychometric assessments.

Personal information about you may also be collected from a third party. For example when the Company receives:

  • any reference about you;
  • results of inquiries of former employers, work colleagues, professional associations or registration body;
  • the results of any psychometric, competency or medical test;
  • performance feedback from your previous or earlier employer;
  • any complaint from or about you in the workplace from your previous or earlier employer;
  • any information about a workplace accident in which you are involved from your previous or earlier employer;
  • any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved.

If and when we will take reasonable steps to collect personal information from 3rd and ensure you are aware of the purposes for which the Company has collected your personal information.

How we may use and disclose your personal information?

The Company may use and disclose the personal information it collects about you for the following purposes:

  • to provide job placement;
  • for other purposes for which you have engaged the Company.

The Company may also disclose your personal information to a third party if they have a proper interest in the disclosure, such as:

  • a member of the  Company;
  • The Company insurers;
  • a professional association or registration body;
  • a workers’ compensation body;

If the Company engages a third-party contractor to perform services which involves handling personal information, it takes reasonable steps to prohibit the contractor from using personal information except for the purposes for which it was supplied.

If you do not give the Company the information it seeks, it is unable to provide you with the right job placement and to successfully match the right jobseeker to the right employer.

Security of your personal information

Your personal data may be held and stored by the Company in either electronic of physical form. The Company has made reasonable security arrangements to protect your personal data to prevent unauthorised, access, collection, use, disclosure, copying, modification, disposal or similar risks.

In respect of your personal data stored in the electronic or physical form, the Company has adopted the following security measures:

  1. Administrative measures
  2. Physical measures
  3. Technical measures

 

You can request access to your information

You may request, by way of e-mail to the DPOs, to have access to your personal data in the Company’s possession or under its control and information about the ways in which your personal data may have been used and /or disclosed by the Company within the period of one year before the date of request. Your e-mail should provide sufficient detail to enable the Company to respond to your request. The Company may charge a fee for responding to your request. If so, the Company will provide you with a written estimate of such a fee for your agreement.

Keeping your personal information up to date

You may also request, by way of e-mail to the DPOs, to correct an error or omission in your personal data in the Company’s possession or under its control. Your e-mail should provide sufficient detail to enable the Company to respond to your request. The Company will respond to your request within 30 days after receiving your request in accordance with all applicable laws. If the Company is unable to respond to your request within 30 days after receiving your request, the Company will within that time inform you in writing of the time by which it will respond to your request. Unless the Company is satisfied on reasonable grounds that a correction should not be made, the Company will correct your personal data (at no charge) as soon as practicable.
